(4) The contractor shall also report the information in paragraph (h)(1) if the contractor wishes to ask for a waiver of the requirements of a new FASCSA order being applied through modification. (i) New FASCSA orders report. (1) During contract performance, the Contractor shall review SAM at least once every three months, or as instructed by the Contracting Officer, to check for covered articles subject to FASCSA order(s), or for products or services produced by a source subject to FASCSA order(s) not currently identified under paragraph (e) of this clause. (2) If the Contractor identifies a new FASCSA order(s) that could impact their supply chain, then the Contractor shall conduct a reasonable inquiry to identify whether a covered article or product or service produced or provided by a source subject to the FASCSA order(s) was provided to the Government or used during contract performance.

(d) Incident Response Requirements. (1) All determinations by the Department related to incidents, including response activities, will be made in writing by the Contracting Officer. (2) The Contractor shall provide full access and cooperation for all activities determined by the Government to be required to ensure an effective incident response, including providing all requested images, log files, and event information to facilitate rapid resolution of incidents. (3) Incident response activities determined to be required by the Government may include, but are not limited to, the following: (i) Inspections; (ii) Investigations; (iii) Forensic reviews; (iv) Data analyses and processing; and (v) Revocation of the Authority to Operate (ATO), if applicable. (4) The Contractor shall immediately preserve and protect images of known affected information systems and all available monitoring/packet capture data.
