Other Than Commercial Computer Software: R-DFARS 252.227-7989 (DEVIATION 2026-O0036) describes requirements for incorporation of third party other than commercial copyrighted computer software and computer software documentation and is incorporated as follows: The Contractor shall not, without the written approval of the Contracting Officer, incorporate any copyrighted computer software or computer software documentation in the software or documentation to be delivered under this contract unless the Contractor is the copyright owner or has obtained for the Government the license rights necessary to perfect a license or licenses in the deliverable software or documentation of the appropriate scope set forth in R-DFARS 252.227- 7989 (DEVIATION 2026-O0036) and prior to delivery of such— (1) Computer software, has provided a statement of the license rights obtained in a form acceptable to the Contracting Officer; or (2) Computer software documentation, has affixed to the transmittal document a statement of the license rights obtained.

Submission

Actions Required by Offerors/Contractors at proposal submission.** (a) In accordance with AFRLI 61-113, S&T Protection, Offerors/Contractors are required to submit the following documentation with their proposal: (1) Contract or Other Transaction Agreement (OTA) proposals: (i) Research and Related Senior and Key Person Profile Worksheet (See Appendix 2) AND; (ii) Security Program Questionnaire (See Appendix 1) AND; (iii) “Privacy Act Statement” consent form for each Covered Individual that is also signed by the Offeror/Contractor as that Individual’s Sponsor. (See “Covered Individual” section below, and Appendix 3) (2) In the event a security risk is identified, and the Government has determined the security risk exceeds the acceptable threshold, the Offeror/Contractor will be notified and informed of the decline of award. **The Government will provide as much rationale for the decision as Government OPSEC measures allow for.** Challenges under awards made solely for Fundamental Research shall follow the OSD R&E Memorandum dated 6 June 2023.
